Terms and Conditions – Online Store Development
1. Purpose of Service
ArteMedia provides custom online store design and development services. These Terms and Conditions regulate the relationship between the client and ArteMedia in relation to such services.
2. Scope of Service
The service includes:
Design and development of the online store according to the agreed specifications.
Integration of available payment and shipping methods.
Basic search engine optimization (initial SEO).
Basic training for product and order management.
Initial technical support after launch (timeframe defined in the proposal).
Any additional functionality must be requested and quoted separately.
3. Client Obligations
The client agrees to:
Provide all required content in a timely manner (texts, images, logo, product information, etc.).
Review and approve deliverables within the agreed deadlines.
Make the payments established in the contract or accepted quotation.
4. Payments and Conditions
The client must pay the agreed initial deposit to begin the project.
The remaining balance must be paid according to the deadlines established in the proposal or invoice.
Payments are non-refundable once the project has started, unless otherwise expressly agreed.
5. Delivery Times
Delivery timelines depend on the complexity of the project and the client’s responsiveness in providing materials and approvals.
6. Intellectual Property
The client retains ownership of all content provided (texts, images, logo, etc.).
ArteMedia retains copyright over the design and development until full payment is received.
Once the service is fully paid, ownership of the online store is transferred to the client, except for third-party components (plugins, themes, or external licenses).
7. Maintenance and Support
Initial support is included for a limited time (defined in the proposal).
Ongoing maintenance, updates, or future modifications may be contracted through additional plans.
8. Limitation of Liability
ArteMedia shall not be held liable for:
Service interruptions caused by hosting failures, external providers, or payment platforms.
Errors resulting from modifications made by the client or unauthorized third parties.
Data loss due to client negligence in managing access or backups.
9. Confidentiality
Both parties agree to maintain confidentiality regarding any information shared during the development of the project.
10. Jurisdiction
These Terms and Conditions shall be governed by the laws of Puerto Rico, and both parties submit to the jurisdiction of the competent courts in San Juan.
